ONLINE TERMS OF SALE

This website, www.arteke.com.au (Site), is owned and operated by Arteke Salon Collective and its related and associated bodies corporate (we, us, ourPurchase) will be subject to the following online terms of sale (Online Terms of Sale).

You must be at least 18 years old to make a purchase.

Orders

An order placed by you on the Site for products is only an offer by you to purchase a product for the price displayed on the Site. We reserve the right to accept or reject your offer for any reason. Reasons may include, but are not limited to, the unavailability of a product or service or an error or change in the price displayed on the Site.

Colour Matching

You may contact us for advice on hair colour. If you send us a small sample of your hair, we will colour match it as best as we can. You acknowledge that we will not be responsible or liable for any difference between the colour of any sample you provide to us and the colour of any product we provide to you. You also acknowledge that the colours of any items delivered to you may vary slightly from the colours displayed by your computer monitor.

Prices

The prices of products displayed on the Site may change from time to time. Unless stated otherwise, prices are inclusive of goods and services tax. The prices of products displayed on the Site are expressed in Australian dollars.

Payment

Payment for Purchases may be made by either one of the following methods:

(i) Credit card: Visa or Mastercard

(ii) paypal

All credit card orders placed online are via our secure server.

Refunds and Exchanges

We will exchange a product if it is returned to us within 10 days of being received by you, unopened and unused, with original packaging and labels, however, only if you notify us of your decision to exchange the product within 2 days of it being received by you. We do charge a 20% restocking fee. We do not give a refund for a product if you simply change your mind or make a wrong decision. We will give you a refund if a product is damaged or faulty, does not match its sample or description, or does not do what it is supposed to do, or if we are otherwise required to do so by law.

Shipping

Orders are processed Tuesday to Saturday and delivered Tuesday to Friday.

Arteke ships all orders from Port Stephens via Australia Post. This extensive delivery network is supported by one of the largest transport fleets in Australia. Delivery lead times will be based on location. Delivery areas further away from Sydney and rural addresses will result in longer lead times.

If we are provided with an address that is incorrect or incomplete, causing the order to be sent back to us, once the correct address is confirmed a postage fee of $10 will be incurred for sending out the order a second time. This will be provided in the way of invoice and must be paid before we resend the order again.

Faulty Goods

If you think there is a fault with an item that you received, please contact us immediately for a replacement or refund. The cost of returning the item to us will be at your expense if the item is faulty 30 days after delivery. If you have received a product that is not working satisfactorily on first use, please contact us. We take care to pack your items carefully so that they won't get damaged in transit. If, for whatever reason, they arrive damaged, we ask that you let us know within 7 days of receiving them in the mail.

Title and Risk in Products

A product delivered by us to you remains our sole and absolute property until all money due to us has been paid, however, a product will be at your own risk from the time the product is removed from storage or our

warehouse for the purpose of delivery to you. You will be responsible for obtaining any necessary insurance in respect of a product shipped to you.

Amendment of Online Terms of Sale

We may, in our absolute discretion, modify or amend the Online Terms of Sale from time to time. Any modifications or amendments will be binding on you once displayed on the Site.

General

We do not accept any liability for our failure to comply with the Online Terms of Sale where the failure is due to circumstances beyond our reasonable control. A failure by us to exercise a right, power or privilege available under the Online Terms of Sale will not constitute a waiver of such a right, power or privilege. If we waive any rights available to us under the Online Terms of Sale on one occasion, this does not mean that those rights will automatically be waived on any other occasion. If any of the Online Terms of Sale are held to be invalid, unenforceable or illegal for any reason, the remaining Online Terms of Sale will continue in full force.
